Hey as far as I'm concerned the only piece of software worth taking a claim over on here is vB, and believe it or not there have been legal cases over the unauthorized use of a plugin or a modification of a theme. These all still do fall into the category of intellectual property. I've been down that road before when I added a slightly modified version of a plugin onto my vbulletin, I got a string of angry emails telling me to take off the modification or face a law suit. In the end I just told him to piss off and it all worked out great.
